1.  This Privacy Policy has been prepared in accordance with our obligations and your rights set out under the Privacy Act 2020.

2.  The New Zealand Olympic Committee (referred to in this Privacy Policy as "we", "our", "us" or “NZOC”) as the National Olympic Committee for New Zealand is committed to safeguarding the privacy of individuals.

3.  The NZOC Official Online Store (the "Store") is operated by The Business of Sport Limited ("TBOS") as our authorised e-commerce operator. The New Zealand Olympic Committee is the ‘data controller’ and ‘data owner’. We determine the purposes for which your personal information is collected and how it is used. The Business of Sport Limited (TBOS) is a ‘data processor’. TBOS processes personal information solely on our behalf and under our instructions, and is contractually bound to protect your privacy.

4.  This Privacy Policy will apply to all individuals providing personal information through the Store (referred to in this Privacy Policy as "you" and "your"). The purpose of this Privacy Policy is to inform you as to what information may be collected from you, how such information will be used by us and/or other persons or entities with whom such information may be shared, your choices regarding the collection, use and distribution of such information, your ability to access or correct such information, and the security procedures we have implemented to protect your privacy.

 

What information do we collect?

5.  We will only collect personal information that is necessary for one or more of our activities or functions in operating the Store and providing related services to you. Personal information may include:

(a)  Contact details: your name, email address, postal and delivery address, and phone number.

(b)  Account information: username and password if you create a Store account.

(c) Order and transaction information: products purchased, order history, and transaction records.

(d)  Communications: enquiries, customer service correspondence, and feedback you submit to us.

6.  We also collect certain information automatically when you use the Store, including device and browser information, IP address, approximate geographic location, and information about how you navigate and use the Store (via cookies and analytics tools). See paragraph 16 regarding cookies.

7.  Payment card details are processed directly by our PCI-DSS compliant payment gateway provider. We do not store your full payment card details.

8.  We always collect information by lawful and fair means. We will only collect personal information where it is reasonably necessary for us to operate the Store and fulfil your orders, and to comply with our legal obligations.

Providing personal information is voluntary. However, if you choose not to provide certain personal information, we may not be able to provide certain services, such as processing your order, delivering products, creating or maintaining your Store account, or providing customer support.

 

How do we use your personal information?

9.  We will only use your personal information for the purposes for which it was collected, or otherwise as required or authorised by law. This may include using your personal information for the following purposes:

(a)  To process and fulfil your orders, including delivery, returns, and customer service.

(b)  To send you order confirmations, dispatch notifications, and other transactional communications.

(c)  To maintain and develop our Store systems, including testing and upgrading them.

(d)  For our administrative purposes and for internal record keeping.

(e)  To comply with relevant laws and regulations.

(f)  To undertake promotional activities and communicate with you about NZOC programmes, events, merchandise, and campaigns (see paragraph 10 regarding direct marketing).

(g)  For fraud prevention, security, and dispute resolution.

(h)  For any other specific purpose which we notify you of at the time your personal information is collected.

10.  From time to time, we may also contact you for market research purposes or to provide you with special offers, promotions, or opportunities from our commercial partners. We will give you the opportunity to opt out of receiving such direct marketing or market research content at any time.

 

Do we share or disclose personal information?

11.  As the Store operates on behalf of the NZOC, contact details and order information collected through the Store will be shared with and held by the New Zealand Olympic Committee. The NZOC is the owner of this data. As a Store customer you are also a valued member of the wider NZOC community, and the NZOC may use your contact information to communicate with you about Olympic programmes, events, merchandise, and campaigns consistent with the purposes set out in paragraph 9.

12.  If you do not wish your contact details to be used by the NZOC for marketing or promotional purposes, please contact us using the details set out in paragraph 20. You may also unsubscribe from any NZOC marketing communications at any time using the unsubscribe link in those communications.

13.  We may also disclose your personal information to other entities as necessary to operate the Store and fulfil our obligations to you, including:

(a)  TBOS, as our authorised operator, and contractors, agents and service providers who help us perform our operational functions (including courier and logistics providers, email and marketing platform providers, and website hosting and analytics providers).

(b)  Our payment gateway provider, for the purpose of processing your transaction.

(c)  Our professional advisers and insurance providers.

(d)  Where you have otherwise consented.

(e)  As required or authorised by law.

14.  We will take reasonable steps to ensure that the persons and organisations to whom we disclose personal information are bound to protect the privacy of that personal information. Please note that some of the persons to whom we disclose personal information may be situated outside New Zealand (see paragraph 22 below). We do not sell your personal information to any third party.

15.  The Store is hosted and powered by Shopify Inc. As a result, information you submit through the Store will be transmitted to and processed by Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Store for you. Shopify may also make use of personal information collected about your interactions with our Store in connection with its own enhanced features and services. In these circumstances, Shopify is responsible for the processing of your personal information for those purposes. Cookies and tracking technologies

16.  The Store uses cookies and similar tracking technologies to maintain your shopping session and cart, remember your preferences, and analyse traffic and usage patterns to improve the Store. You can manage your cookie preferences through your browser settings. Please note that disabling certain cookies may affect the functionality of the Store.

 

How do we protect your personal information?

17.  We will take reasonable measures to ensure the security of your personal information held by us from such risks as loss, misuse, unauthorised access, disclosure, alteration and destruction. We remind you, however, that if you send information to us via the Internet, the Internet is not a secure environment and although all reasonable care is taken, we cannot warrant or guarantee the security of information you provide to us via electronic means.

 

How can you access and correct your personal information?

18.  If you identify any inaccuracy in your personal information, or you need to make a change to or would like to verify such information, please contact us so that we may update our records. Our contact information is set out in paragraph 23 below.

19.  Where you request details of your personal information and the information requested is not readily retrievable, we may charge a reasonable fee for the cost of accessing or retrieving that information. We note that we are not required to provide access to information in certain situations, but if we refuse access, we will give you our reasons for doing so.

20.  You may also request a copy of the personal information we hold about you in a portable format, or request that we transfer it to a third party where this is technically feasible. Please contact us using the details in paragraph 23 to make such a request.

 

For how long do we hold personal information?

21.  We will keep your personal information for only as long as is necessary to achieve the purpose for which we collected it. In practice this means:

(a)  Order and transaction records are retained for a minimum of seven years for tax and legal compliance.

(b)  Account information is retained for the duration your account is active plus a reasonable period thereafter.

(c)  Marketing contact information is retained until you withdraw consent or request removal.

 

Transfer of personal information outside New Zealand

22.  We may store personal information within services provided by offshore cloud service providers, including Shopify. Some of the recipients of your personal information referenced above may be based in countries or regions outside New Zealand. Accordingly, any personal information that is collected in connection with the Store may be transferred to countries or regions where those recipients may not be required to protect the information in a way that, overall, provides comparable safeguards to those in the Privacy Act 2020. We will ensure that any such transfer of personal information will only be undertaken in compliance with the Privacy Act 2020.

 

Changes to this Privacy Policy

23.  We may modify this Privacy Policy from time to time and if we do so, we will post any updated Privacy Policy on our website. We encourage you to check this website periodically to ensure that you are aware of the terms of our current Privacy Policy.
