Official New Zealand Team Online Store

By using, accessing, or placing an order through the Official New Zealand Team Online Store ("Store") you agree to be bound by the terms and conditions set out below ("Terms"). If you do not accept the Terms you are not permitted to use the Store and must not place an order.
1. About the Store: The Store is operated by The Business of Sport Limited ("TBOS") as the authorised e-commerce operator on behalf of the New Zealand Olympic Committee ("NZOC", "we", "our" or "us"). All merchandise sold through this Store is official NZOC-licensed product. References to "we", "our" or "us" in these Terms mean the NZOC and TBOS acting in their respective capacities.
2. Changes to the Terms: Please be aware that we may vary these Terms from time to time by publishing the varied Terms on the Store. Any changes will come into effect after 30 days of the varied Terms being published on the Store. Your continued use of the Store following any such changes to the Terms coming into effect will be regarded as acceptance of the new Terms. It is your responsibility to check these Terms periodically for any changes, including before you place an order through the Store.
3. Eligibility: By placing an order you agree to use the Store in a manner that complies with all applicable laws and regulations, and in accordance with these Terms. You confirm that:
(a) you are at least 18 years of age, or have the consent of a parent or legal guardian;
(b) the personal and payment information you provide is truthful, accurate and complete; and
(c) if you choose to access this Store from outside of New Zealand, you are also responsible for complying with the applicable local and national laws of that country.
4. Protection of Information: You should be aware that the information on this Store is protected by copyright, trademark and other intellectual property laws and rights, including without limitation photographs, content, text materials, graphics, software, tools, trademarks, service marks, company names and logos, audio and visual elements. All rights, title and interest in such intellectual property rights, copyright and trademark are owned, licenced or controlled by the New Zealand Olympic Committee.
5. You may use information on the Store and reproduce it in hard copy for your personal reference or share it for non-commercial purposes. You must retain all copyright and other proprietary notices as they appear in the original material. You may not modify any content on the Store or present any modified content as official New Zealand Olympic Committee material. You may not frame, link or otherwise incorporate any information contained within the Store into any other website or service without the prior written consent of the New Zealand Olympic Committee.
6. Your use of the Store: You agree to use the Store in a manner that complies with all applicable laws and regulations. You agree that you will ensure your use of the Store does not infringe the rights of any other person or entity or restrict or inhibit their use and enjoyment of the Store. The Store may be accessed via standard web browsers only. Access by any other method (including but not limited to scraping, harvesting, data mining or any other extraction or data-gathering method) is prohibited without our prior written consent.
7. Without limiting the generality of this provision, you agree not to:
• submit for posting or otherwise distribute any content that violates, plagiarises or infringes upon the rights of any third party, including any copyright, trademark, privacy or other personal or proprietary rights;
• use the Store directly or indirectly to post or transmit any content that is unlawful, obscene, defamatory, abusive, harassing, threatening, offensive or false, misleading or deceptive in any way;
• attempt to gain unauthorised access to the Store or use another person's account or password;
• knowingly provide registration or personal information that is not truthful;
• tamper with, hinder the operation of, or make unauthorised modifications to the Store;
• knowingly transmit any virus or other disabling feature to the Store; or
• engage in any other conduct that we consider (in our absolute discretion) to be in breach of these Terms or otherwise inappropriate.
Products, Pricing & Orders
8. Products: We take care to accurately describe all products on the Store. Colours may vary slightly due to screen calibration. While the Store's purpose is to provide accurate product information, information is provided on an "as is" basis. We reserve the right to correct any errors in product descriptions or pricing at any time.
9. Pricing: All prices are displayed in New Zealand Dollars (NZD) and are inclusive of GST at the prevailing rate unless otherwise stated. Prices are subject to change without notice. The price charged will be the price displayed at the time your order is confirmed. All products are subject to availability and we reserve the right to limit quantities or discontinue products at any time.
10. Orders: Placing an order constitutes an offer to purchase. A binding contract is formed only when you receive an order confirmation from us. We reserve the right to refuse or cancel any order at our reasonable discretion, including where a product is out of stock, payment cannot be processed, an error in pricing or product information is identified, or we suspect fraudulent activity. Where an order is cancelled after payment pursuant to this clause 10, a full refund will be issued via the original payment method.
11. Payment: We accept major credit and debit cards and other payment methods as displayed at checkout. All transactions are processed through secure, PCI-DSS compliant payment gateways. We do not store your full card details on our servers.
Shipping & Delivery
12. Delivery: We ship to New Zealand and many international countries (refer to Shipping Policy for country list). Estimated delivery timeframes are displayed at checkout and are estimates only — they are not guaranteed. We are not liable for delays caused by courier services, customs, or events outside our control. Risk in products passes to you upon delivery to the address provided. Title passes upon receipt of full payment.
Returns, Refunds & Exchanges
13. Consumer Guarantees Act 1993: Nothing in these Terms limits or negates your rights or remedies under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986. Where the CGA applies, you may be entitled to a remedy if a product is not of acceptable quality, not fit for purpose, or does not match its description. We do not offer change-of-mind returns. If and to the extent you acquire our products in trade, for the purposes of section 5D of the Fair Trading Act 1986 and section 43 of the CGA, you and we agree to the extent permitted by law that: you and we are all in trade; sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 and the provisions of the CGA do not apply in relation to these Terms or as between you and us; and it is fair and reasonable to exclude their application.
14. Faulty or Incorrect Items: If you receive a faulty, damaged or incorrect item, please contact us within 14 days of delivery. We will arrange a replacement, exchange or full refund including return shipping at our cost. Approved refunds are processed within 5–10 business days to the original payment method.
15. Disclaimer: While we use reasonable endeavours to ensure the accuracy of information on the Store, the information is provided on an "as is" basis and without warranties of any kind, express or implied, including but not limited to accuracy, correctness, timeliness, completeness or fitness for purpose. Access to, and the availability of, the Store may be interrupted, restricted or delayed from time to time. We do not give any warranties of any kind, expressed or implied, in respect of the availability or performance of the Store.
16. The Store may contain links to third party websites. These websites have not been prepared by us and are not controlled by us. We are not responsible for, and do not guarantee the performance of, goods and services provided by any third party to whose website we may provide a link. Navigating links to external websites is at your own risk.
Liability
17. Liability: Except to the extent that the law prohibits exclusion of liability, and subject to any rights or remedies you may have under the CGA, we shall not be liable to you as a user of the Store for any loss, damage or expense (whether direct, indirect or consequential) incurred by you or any third party, and all warranties, representations and guarantees (whether express, implied or statutory) are excluded, including without limitation fitness for purpose, accuracy or completeness of the Store, its content or the goods and services that are offered for supply and supplied via the Store.
18. To the full extent permissible by New Zealand law, we disclaim all responsibility for damages or losses (including without limitation financial loss, damages for loss of revenue, loss of profits or savings, and indirect or consequential loss) arising in contract, tort (including negligence) or otherwise from your use of, or inability to use, the Store, or any material appearing on the Store, or from any action or decision taken as a result of using the Store. Our total aggregate liability to you for any claim directly arising from a purchase shall not exceed the total amount you paid for the relevant order.
19. Termination: In the event that you commit any breach of these Terms or that we believe you have misused the Store (in our reasonable discretion), we may terminate your right (or restrict your access) to the Store immediately without notice, and without prejudice to any other rights or remedies available to us.
20. Cookies: The Store may use "cookies" to provide you with access to tailored information and services and to serve you better when you return to it. A Cookie is a small data file that the Store sends to your browser, which may then be stored on your system for later retrieval. Cookies track your movements through different websites and are widely used to help with navigation and to personalise your experience. You can manage your cookie preferences through your browser settings, though this may affect Store functionality.
21. Security of Information: Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. Whilst we will strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to the Store. Accordingly, any information which you transmit to the Store is transmitted at your own risk. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information. You should never share your secure information, password or identifier with any other person.
22. Additional Terms: You may need to agree to additional terms and conditions for any promotions or competitions which may be available to you from time to time through the Store, prior to being able to obtain or participate in such promotions or competitions. Any such additional terms and conditions must be read in conjunction with these Terms. In the event of any inconsistency between these Terms and any promotion or competition terms and conditions, the relevant promotion or competition terms and conditions will prevail.
23. Privacy Policy: The Privacy Policy available on the Store governs the collection, use and disclosure of your personal information in connection with the Store. The Privacy Policy forms part of these Terms.
24. Governing Law: These Terms are governed, and to be interpreted, by New Zealand law and will be subject to the non-exclusive jurisdiction of the courts of New Zealand.
25. UNCISG: The United Nations Convention on Contracts for the International Sale of Goods does not apply to the sale of goods via the Store.
